Norway's Data Protection Authority demands active consent before biological material from criminal cases is used in research

    • Datatilsynet agrees with the goal but rejects the key part of the proposal: people must actively say yes before their biological material from criminal cases can be used in research — being able to opt out is not enough. An opt-out can work for method development and quality checks.
    • The proposal treats suspects, the accused, convicted persons, and victims the same way. Datatilsynet says that is wrong, because these groups are in very different situations.
